What's the denied boarding?

Somentimes airline companies denies boarding to some air passegers. This can be due to the practice of overbooking when air companies sell or book a greater number of tickets in comparison of the seats available on board. The consequence of overboking is that some air passengers lose their flight.

There are also further reason of denied boarding, e.g.:

  • during high season, when fhights are more crowded, air companies can chooce to board before passengers whose flights has been cancelled, so dening boarding to others.
  • or if the flight has been booking just in advance of the departure, air companies can deny boarding to a passenger even if he/she get the boarding card.
Are You Entitled to get a compensation in the event of denied boarding?

If the air companies deny You boarding, You are entitled to get the a compensation (monetary compensation) between EUR 250 (about 210 GBP) and EUR 600 (about 510 GBP) per person.

Specifically, the compensation is 250 € for routes less than 1500km, 400,00 € for routes between 1500km and 3.500km and 600.00 € for routes more than 3.500km.
Do I Have further rights in case of denied boarding?

Besides of the compensation for the denied boarding, You can choose to get by the airline company alternatively:

  • A ticket for a different flight
  • A reimbursement of the flight ticket.

You also have the right to be assisted by the airline company with:

  • Meals and beverages

If you have suffered material, moral or existential damages (e.g. the loss of a vacation day), You have the right to get additional compensation besides the monetary one.

Lost / Missed Connecting Flight

What’s the case of the lost flight connection?

A missed flight connection can occur when the air passenger, to get his/her destination, has to book two or more following flights:
If the first flight is delayed, the air passenger coundn’t be on time to board on the following flight and so he/she losses the connecting flight.

Infortuni del Passeggero Durante il Viaggio

In aereo

Se l’infortunio ha luogo durante il volo aereo o nel corso delle operazioni di imbarco e di sbarco la responsabilità è della compagnia aerea, che deve risarcirti fino a 113.100 DSP (diritti speciali di prelievo).
In caso di incidente la compagnia è tenuta ad anticipare il risarcimento danni nei confronti degli aventi diritto.

In nave

Se l’infortunio avviene a bordo della nave (dall’inizio dell’imbarco fino al compimento dello sbarco) il vettore marittimo sarà tenuto a risarcirti il danno.
In caso di trasporto marittimo internazionale, la responsabilità comprende i danni derivanti dalla morte o dalle lesioni personali subite a causa di un incidente, se l'evento dannoso è imputabile a colpa o negligenza della nave.
In tal caso la responsabilità del vettore marittimo è limitata a 400.000 DSP. Il diritto al risarcimento deve essere fatto valere entro due anni dalla data di sbarco.

In treno

Se l’incidente che provoca l’infortunio avviene sul treno, la responsabilità è della compagnia ferroviaria che è tenuta a risarcire te e/o i tuoi congiunti.
La compagnia deve effettuare il pagamento anticipato necessario a soddisfare le immediate necessità economiche della vittima dell’incidente o dei suoi congiunti entro 15 giorni dall'identificazione della persona fisica che ha diritto al risarcimento. In caso di decesso, il risarcimento danni non può essere inferiore a 21.000 euro.

In autobus

Hai diritto al risarcimento dei danni se l’infortunio avviene in seguito a un incidente su autobus di linea.
Per quanto riguarda i servizi a lunga percorrenza (ovvero per tratte superiori a 250 km), la legislazione comunitaria obbliga la compagnia a prestare assistenza immediata (che comprende. se necessario, sistemazione, cibo, indumenti, trasporto) e a risarcirti in caso di decesso o lesioni personali.

In hotel o struttura alberghiera

Se l’infortunio avviene in albergo la struttura ricettiva è tenuta al risarcimento.

IMPORTANTE

In caso di viaggio organizzato il tour operator o organizzatore di viaggi è responsabile e tenuto al risarcimento insieme alle compagnie di trasporto o strutture alberghiere.

Ricorda sempre di munirti di prove come:

  • verbali di pronto soccorso;
  • certificazioni mediche;
  • fatture delle terapie sostenute;
  • spese per medicine.

In questo modo potrai richiedere il danno patrimoniale e il danno da vacanza rovinata (se l’infortunio è tale da incidere negativamente sulla vacanza stessa).
